Terms of use

These terms govern your use of RocNest. By creating an account or using the service you accept them. Read them carefully: RocNest is provided free of charge and therefore with no availability commitment and no warranties.

Who provides the service

RocNest is a service of Ingenieros Web S.L., Spanish tax ID (CIF) B86699436, registered at C/ Ordicia 31, 28041 Madrid, España. For any question write to info@ingenierosweb.co.

Free service, no warranty, no committed availability

RocNest is provided free of charge and "as is", without warranty of any kind. We make no availability commitment: there is no service level agreement, no uptime percentage, no committed response time and no support obligation.

Concretely, anyone using the service free of charge cannot claim from us:

  • that the service is available at any given moment, or continuously;
  • that it runs without errors, interruptions, data loss or performance degradation;
  • that specific features are kept, remain unchanged or are not withdrawn;
  • that support is provided, incidents fixed or requests answered within any given time;
  • any financial compensation arising from the above.

We may interrupt or shut down the service

We may modify, suspend or discontinue RocNest, in whole or in part, at any time and with no obligation to compensate. If we decide to shut the service down, we will give reasonable notice in the application so you can export your data, but that notice is a good-faith commitment, not a contractual guarantee.

We strongly recommend you keep your own copies of any information that matters to you. We are not a backup service.

If paid plans exist in the future

Today RocNest is entirely free. If we ever offer a paid plan, it will have its own terms, and those terms — not these — will determine the warranties, availability and support owed to whoever subscribes. The limitations in this section apply to free use.

Who may use RocNest

You must be over 14 to create an account. If you create it on behalf of a club, federation or organisation, you represent that you have authority to bind it to these terms.

You are responsible for keeping your credentials confidential and for everything that happens in your account.

Acceptable use

When using RocNest you agree not to:

  • use it for unlawful purposes or to infringe third-party rights;
  • attempt to access other organisations’ data, or parts of the system you are not authorised for;
  • place automated load that degrades the service for others;
  • enter third-party personal data without a legal basis to do so.

Your data and your club’s

The content you enter — inventory, bookings, loans, reviews — remains yours. We process it only to provide the service, under the terms of the privacy policy.

If you manage data about your club’s members, you or your organisation are the controller of that data and must have the appropriate legal basis to process it. We act as processor.

The software is open source

RocNest’s code is released under the GNU Affero General Public License v3.0 and is available at github.com/vgpastor/RocNest. That licence governs your rights over the code, including running your own deployment. These terms govern the use of the service we host, which is a different thing.

The RocNest name, logo and graphic elements are not covered by that licence.

Account suspension

We may suspend or close an account that breaches these terms, endangers the security of the service or harms other users. Where possible we will warn you first.

You may delete your account at any time from the application or by writing to us.

Limitation of our liability

To the fullest extent permitted by law, we are not liable for indirect damages, loss of profit, loss of data, or losses arising from the unavailability of the free service.

This limitation does not exclude liability that cannot be excluded by law: liability arising from wilful misconduct or gross negligence, liability relating to personal data protection, and any liability owed to consumers under mandatory rules.

Changes to these terms

We may update these terms. We will publish the new version here with its date, and if the change is substantial we will announce it in the application. Continuing to use RocNest after a change means accepting it.

Governing law

These terms are governed by Spanish law. For any dispute the parties submit to the courts of Madrid, unless consumer rules assign jurisdiction elsewhere, in which case those rules prevail.
